The EAA across EU countries: laws, authorities, penalties

The EAA is a common EU directive, but each country has its own transposing law and supervisory authority. Here is an overview for five markets.

Poland

Act of 26 April 2024 on ensuring accessibility requirements. Supervision: the President of the PFRON Management Board and market surveillance authorities.

Germany

Barrierefreiheitsstärkungsgesetz (BFSG). Supervision: the MLBF and the federal states' authorities. Penalties up to €100,000.

France

Ordinance No. 2023-859 of 6 September 2023. Supervision: ARCOM and DGCCRF. Penalties up to €50,000.

Spain

Law 11/2023 of 8 May 2023. Supervision: the Directorate-General for Consumer Affairs and the autonomous communities' authorities. Penalties up to €1,000,000.

Italy

Legislative Decree of 27 May 2022, No. 82. Supervision: AgID. Penalties from €5,000 to €40,000.
